Terms and Conditions

1. About These Terms and Conditions
   
   

   These Terms and Conditions contain information on how to participate in the Program. By participating in the Program, you agree to be bound by these Terms and Conditions.

2. About the Organizer
   
   

   2.1 We are Techtronic Power Tools (M) Sdn. Bhd. (Company registration number: 1003816-H) with its registered address at No.29, Jalan 51/225A, Zon Perindustrian PJCT, Sekyen 51A 46100 Petaling Jaya, Selangor Darul Ehsan, Malaysia. The Program is organized by us.

   2.2 You may contact us by:

3. Eligibility
   
   

   To be eligible for participating in Program, you must be an individual who is at least 18 years old at the time of participation.

4. About the Program
   
   

   4.1. The Program will take place from 19 August 2024 to 31 December 2024 (both days inclusive) (“Program Period”) at:
   (a) Milwaukee Tool Malaysia HQ (Address: No.29, Jalan 51/225A, Zon Perindustrian PJCT, Sekyen 51A 46100 Petaling Jaya, Selangor Darul Ehsan, Malaysia);
   (b) Milwaukee Tool Malaysia – Sarawak (Address: Sublot 35 & 36 of Parent Lot 3257 Block 16, Kuching Central Land District Galacity, 93350 Kuching, Sarawak, Malaysia); and
   (c) the physical stores of our authorized dealers in Malaysia (each an “Authorized Dealer” and collectively the “Authorized Dealers”)
   (each a “Participating Store” and collectively the “Participating Stores”).
   For the details of our Authorized Dealers, please contact us in accordance with Clause 2.2.

   4.2 Subject to the stock availability of the battery bundles described in the second column of the table below (each a “Battery Bundle” and collectively the “Battery Bundle”), during the Program Period, you may purchase the Battery Bundles at the promotional prices set forth in the third column of the table below:

   4.3 Subject to the stock availability of the RM 50-worth vouchers (each a “Red Cash Voucher” and collectively the “Red Cash Vouchers”), upon purchase of any one of the Battery Bundles at a Participating Store, you will receive the relevant number of Red Cash Vouchers as set out in the third column of the table below:

5. Use of Red Cash Vouchers
   
   

   5.1 Each Red Cash Voucher is valid from the date of issuance until 31 December 2024, and cannot be extended for any reason. The Red Cash Voucher will be forfeited upon expiry.

   5.2 Each Red Cash Voucher is valid for the net purchase of regular-priced Milwaukee-branded individual goods equal to or greater than RM 500.00 at a Participating Store (“Qualified Purchase”).

   5.3 Each Red Cash Voucher cannot be used to:
   (a) purchase promotional and/or discounted goods;
   (b) purchase combo package(s) and/or set package(s);
   (c) purchase part(s);
   (d) pay all or part of the shipping fee (if any);
   (e) pay for any warranty, repair, and/or maintenance services; and/or
   (f) make online purchase(s) from our website (https://www.milwaukeetool.my/) or such e-commerce platforms as Shopee and Lazada.

   5.4. Each Red Cash Voucher is valid for one transaction and can be used once only.

   5.5. A maximum of ten (10) pieces of Red Cash Vouchers can be redeemed in one (1) Qualified Purchase.

   5.6. To redeem the Red Cash Voucher, you must present the original and valid Red Cash Voucher during checkout. Photocopied, duplicate, an image of, altered, faded, or damaged Red Cash Voucher is not acceptable.

   5.7. If you fail to comply with Clause 5.6 above, once the transaction is completed, you cannot redeem the Red Cash Voucher for that transaction, and we and our Authorized Dealers will not entertain any request to modify or cancel the transaction.

   5.8. The Red Cash Voucher, or any part thereof, is not returnable, transferrable, or exchangeable for any other benefits, including, without limitation, cash or other monetary value, credits, membership points, or any products or services of any kind.

   5.9. The Red Cash Voucher is for your personal use only. The Red Cash Voucher is not for resale by any means and cannot be used for any commercial or promotional purposes.

   5.10. The Red Cash Voucher will not be replaced, accepted or otherwise redeemable if lost, stolen or destroyed.

   5.11. We and our Authorized Dealers reserve the right to refuse to accept the Red Cash Voucher(s) if we or our Authorized Dealer reasonably believes that the use of the Red Cash Voucher(s) is in breach of these Terms and Conditions, fraudulent or otherwise unlawful.

   5.12. If the value of the Red Cash Voucher(s) exceeds the total value of the Qualified Purchase, the difference will not be refunded.

6. Amendments
   
   

   6.1. We reserve the right to, at our discretion, at any time:
   (a) modify these Terms and Conditions;
   (b) modify, suspend, terminate, or cancel the Program, and any aspect thereof, including, without limitation, the process and timing.

   6.2. We will provide reasonable notice of any material changes to these Terms and Conditions or the Program by posting the amended Terms and Conditions or updated Program information, as applicable on our website (https://www.milwaukeetool.my/).

7. Disclaimer of Warranties, and Exclusion of Liabilities
   
   

   7.1. Any representation, warranty, condition, or undertaking that would be implied in these Terms and Conditions by legislation, common law, equity, trade, custom, or usage is excluded to the maximum extent permitted by law.

   7.2. Except for any liability that cannot by law be excluded, we and our affiliates (including their respective directors, officers, employees, and agents) will not be liable for any damage, expenses, costs, liabilities, injuries, claims, or losses whatsoever, whether direct, indirect or consequential, in contract, tort (including negligence), under statute or otherwise, arising out of or in connection with the Program.

8. General
   
   

   8.1. If for any reason any provision of these Terms and Conditions shall be held by a court or other authority to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

   8.2. Failure by us to enforce any of our rights at any stage does not constitute a waiver of those rights. Our legal rights to recover damages or other compensation are reserved.

   8.3. These Terms and Conditions shall be governed by the laws of Malaysia.

   8.4. If you have any complaints about us or the Program, please contact us in accordance with Clause 2.2. We will do our best to resolve any problems you have with us or the Program.
